Hot Tub Rules: No dogs or pets in the hot tub. Children and teens <18 must be directly supervised by an adult. Children < 5 yo must wear a USCG approved life vest while in hot tub (available at no additional charge upon request). HOT TUB USE — ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION 1. Voluntary Use. The hot tub/spa located at the Property is available for Guest’s use solely at Guest’s own election and risk. Guest is not required to use it. 2. Assumption of Risk. Guest understands that use of a hot tub involves inherent risks that cannot be eliminated regardless of care taken, including but not limited to: slipping or falling on wet surfaces; drowning or submersion; burns or overheating (hyperthermia); dizziness, fainting, or cardiovascular events, particularly for pregnant persons, young children, the elderly, and persons with heart conditions, high or low blood pressure, diabetes, or other medical conditions; adverse reactions to water treatment chemicals; and injury or illness from improper water chemistry or bacteria. Guest knowingly and voluntarily assumes all such risks, whether known or unknown, for Guest and for all members of Guest’s party and invitees. 3. Safety Rules. Guest agrees that Guest and all members of Guest’s party will comply with all posted rules and the following: no unsupervised use by minors; no glass in or near the tub; no use while under the influence of alcohol or drugs; limit sessions to no more than fifteen (15) minutes; do not use if pregnant or if you have a relevant medical condition without consulting a physician; and shower before use. 4. Release of Ordinary Negligence. To the fullest extent permitted by Massachusetts law, Guest releases and discharges Host, and Host’s owners, agents, employees, and property managers (“Released Parties”), from any and all claims, demands, or causes of action for injury, illness, death, or property damage arising out of Guest’s or Guest’s party’s use of the hot tub that result from the ordinary negligence of the Released Parties. 5. Indemnification. Guest agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) brought by any member of Guest’s party or invitee, or arising from Guest’s or Guest’s party’s use or misuse of the hot tub or failure to comply with the safety rules above, except to the extent such claims arise from the Released Parties’ own gross negligence, recklessness, or willful misconduct. 6. Limitation. Nothing in this provision releases, limits, or indemnifies against liability for gross negligence, recklessness, willful or wanton misconduct, or any liability that may not be waived under Massachusetts law. If any part of this provision is held unenforceable, the remainder shall remain in full force and effect. 7. Acknowledgment. Guest has read and understands this provision, understands it affects legal rights, and by placement of reservation and use agrees to it voluntarily. OUTDOOR PROPANE FIRE PIT USE — ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION 1. Voluntary Use. The outdoor propane-fueled fire pit located at the Property is available for Guest’s use solely at Guest’s own election and risk. Guest is not required to use it. 2. Assumption of Risk. Guest understands that use of a propane fire pit involves inherent risks that cannot be eliminated regardless of care taken, including but not limited to: burns and scald injuries from open flame, hot surfaces, and radiant heat; fire spreading to clothing, hair, structures, furniture, vegetation, or other flammable materials; propane leaks, flare-ups, flashback, or sudden ignition; explosion or rapid combustion of propane gas; carbon monoxide exposure if used in an enclosed, covered, or poorly ventilated area; eye or respiratory injury from smoke, soot, or flame; tripping or falling on or near the unit, gas line, or propane tank; and injury from moving, tipping, or improperly connecting the unit or tank. Guest knowingly and voluntarily assumes all such risks, whether known or unknown, for Guest and for all members of Guest’s party and invitees. 5. Indemnification. Guest agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) brought by any member of Guest’s party or invitee, or arising from Guest’s or Guest’s party’s use or misuse of the fire pit or failure to comply with the safety rules above, including any fire, property damage, or injury caused to the Property or to third parties, except to the extent such claims arise from the Released Parties’ own gross negligence, recklessness, or willful misconduct. 6. Limitation. Nothing in this provision releases, limits, or indemnifies against liability for gross negligence, recklessness, willful or wanton misconduct, or any liability that may not be waived under Massachusetts law. BACKYARD PLAYGROUND / PLAY STRUCTURE USE — ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION 1. Voluntary Use. The backyard playground and play equipment located at the Property (including any swings, slides, climbing structures, trampoline, or similar equipment) is available for use solely at Guest’s own election and risk. Guest is not required to use it. 2. Adult Supervision Required. Guest acknowledges that the playground is intended for use by children and that children must be supervised by a responsible adult at all times while using or near the equipment. Guest, as the responsible adult, assumes full responsibility for supervising all minors in Guest’s party and permitting their use of the equipment. 3. Assumption of Risk. Guest understands that use of playground and play equipment involves inherent risks that cannot be eliminated regardless of care taken, including but not limited to: falls from swings, slides, climbing structures, or elevated surfaces; collisions with equipment, the ground, or other users; strangulation or entanglement hazards from cords, straps, or clothing; pinch points, splinters, or sharp edges; injuries from equipment failure, wear, or improper use; injuries from ground surfaces or landing areas; and heat-related injury from sun-exposed metal or plastic surfaces. Guest knowingly and voluntarily assumes all such risks, whether known or unknown, on behalf of Guest and all members of Guest’s party, including all minor children in Guest’s care. 4. Safety Rules. Guest agrees that Guest and all members of Guest’s party will comply with all posted rules, all manufacturer instructions, and the following: no use by any child without direct adult supervision; observe any posted age, weight, or capacity limits for each piece of equipment; no more than the recommended number of users on any equipment at one time; no use of equipment that appears wet, damaged, loose, or unsafe; no jumping from slides or swings, no climbing on top of structures, and no roughhousing; remove drawstrings, helmets, and items that could cause entanglement before use; and no use during storms, high winds, or when surfaces are slippery. Guest will inspect the equipment before allowing use and will not permit use if any hazard is observed. 5. Release of Ordinary Negligence. To the fullest extent permitted by Massachusetts law, Guest releases and discharges Host, and Host’s owners, agents, employees, and property managers (“Released Parties”), from any and all claims, demands, or causes of action for injury, illness, death, or property damage arising out of the use of the playground by Guest or Guest’s party that result from the ordinary negligence of the Released Parties. 6. Indemnification. Guest agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) brought by Guest, by any member of Guest’s party, by any minor child in Guest’s care or on such child’s behalf, or by any invitee, arising from the use or misuse of the playground or failure to comply with the safety rules above, except to the extent such claims arise from the Released Parties’ own gross negligence, recklessness, or willful misconduct. 7. Limitation. Nothing in this provision releases, limits, or indemnifies against liability for gross negligence, recklessness, willful or wanton misconduct, or any liability that may not be waived under Massachusetts law. If any part of this provision is held unenforceable, the remainder shall remain in full force and effect. 8. Acknowledgment. Guest has read and understands this provision, understands it affects legal rights, and signs it voluntarily on behalf of Guest and all minors in Guest’s care.
